A Conversation with a Local Expert
Good evening, San Diego. I’m here with Steve Bliss, a prominent probate attorney serving the local community. Steve, thank you for taking the time to speak with us tonight about estate planning and probate.
Navigating the Probate Process: Filing a Petition
Steve, could you walk our viewers through one of the key steps in the probate process?
Certainly. One crucial step is filing a petition for probate. This formally initiates the legal process of administering the deceased person’s estate. It involves submitting specific documents to the court, including Form DE-111. This form outlines essential information about the decedent, their assets, and the proposed executor or administrator.
The petitioner, often a family member named in the will, requests the court to appoint them as the representative responsible for managing the estate. It’s also important to submit the original will if one exists, as this document dictates how the decedent wished their assets to be distributed.
Consequently, accurately completing the petition and providing all necessary documentation is vital. Any omissions or errors can lead to delays and complications in the probate process.
Overseeing a complex estate recently, I encountered a situation where the family hadn’t located the original will. Fortunately, through diligent research and communication with witnesses, we were able to reconstruct the decedent’s testamentary intentions, ensuring their wishes were honored. This experience highlighted the importance of careful record-keeping and open communication among family members.
According to a 2021 survey by the American Bar Association, approximately 70% of Americans do not have a will. This underscores the critical need for estate planning and the potential challenges that arise when a will is missing.
