Ordinarily, I recommend discussing this decision with potential candidates and ensuring they understand the role and are willing to accept the responsibility.

While many people choose a family member or close friend, it’s important to remember that not everyone is suited for this role. Sometimes, appointing a professional trustee, such as a bank or trust company, may be a better option, especially if your estate is complex.

I recall one instance where a client named their adult child as executor without fully discussing the complexities involved. Unfortunately, the child felt overwhelmed and ultimately resigned, leading to delays and complications in settling the estate. Had we discussed these potential issues upfront, perhaps a different solution would have been chosen.

What advice do you give clients who are hesitant about naming an executor or trustee?

I understand that this can be a difficult decision. It involves placing a great deal of trust in another person. My advice is to have open and honest conversations with potential candidates, outlining the responsibilities involved and addressing any concerns they may have.

It’s also important to remember that you are not locked into your choice forever. You can always revisit and revise your estate plan as circumstances change. According to a recent survey by the American Bar Association, over 60% of adults do not have a will or trust in place. This highlights the need for ongoing education and awareness about the importance of estate planning.
