Reporter: Brenda Jones
Today we’re speaking with local Wildomar estate planning attorney, Steve Bliss of Wildomar Probate Law, to gain some valuable insights into the often-complex world of estate planning. Steve, thanks for joining us.
Steve Bliss: It’s a pleasure to be here Brenda.
Steve, many people find the process of estate planning overwhelming. Could you shed some light on one key step that might make it less daunting?
Steve Bliss: Absolutely. One crucial step is determining your goals and objectives.
This involves taking a thoughtful look at what you want to achieve with your estate plan. Do you have specific beneficiaries in mind? Are there charitable causes you wish to support? Perhaps you need to ensure the financial security of minor children or loved ones with special needs.
Clearly defining these goals provides a roadmap for the entire planning process. Consequently, it makes decisions about asset distribution, guardianship, and legal structures like wills or trusts much easier.
Moreover, when your goals are clearly articulated, you can work with an attorney to create a plan that reflects your unique circumstances and wishes. This proactive approach avoids ambiguity and potential conflicts down the road.
Ordinarily, clients come in wanting to simply divide their assets among their children equally. But sometimes those equal shares aren’t truly equitable. For example, one child may have significantly more financial resources than another or require ongoing support due to a disability.
In these situations, I work with the client to develop a plan that reflects not just equality but fairness and addresses the specific needs of each beneficiary.
I recall one instance where a couple wanted to ensure their grandchildren would have access to educational funds even if their children predeceased them. By incorporating a trust provision specifically for this purpose, we were able to provide peace of mind knowing their legacy would continue through future generations.
Reporter: That’s incredibly thoughtful. What about common issues that arise during this goal-setting phase?
Steve Bliss: It’s important to remember that estate planning isn’t a one-size-fits-all process.
People often underestimate the complexity of their assets or fail to consider potential future scenarios. I find it helpful to encourage clients to think broadly about their goals and involve all relevant parties in the discussion, especially if there are blended families or complex financial arrangements. Open communication is key.
Studies by AARP have shown that over 50% of Americans don’t have a will or any estate plan. This can lead to unintended consequences and place a significant burden on loved ones during an already difficult time.
Reporter: Wise words indeed, Steve. How can people connect with Wildomar Probate Law for assistance with their estate planning needs?
