What types of trusts do you typically see clients needing?
Steve explains, “The most common type of trust I set up for clients is a Revocable Living Trust. It’s incredibly versatile and offers numerous benefits.” He continues, “With a Revocable Living Trust, the grantor, who is the person creating the trust, maintains complete control over their assets during their lifetime. They can make changes, add or remove beneficiaries, or even dissolve the trust entirely if circumstances change.”
“The beauty of a Revocable Living Trust lies in its ability to avoid probate,” Steve emphasizes. “Probate is a court-supervised process that can be lengthy and expensive. By transferring assets into a trust, you bypass probate altogether, ensuring a smoother transition for your beneficiaries.”
Can you elaborate on the benefits of avoiding probate?
“Certainly,” says Steve. “Avoiding probate not only saves time and money but also preserves privacy. Probate proceedings are public record, meaning anyone can access information about your assets and beneficiaries. A trust keeps this information confidential, protecting your family’s financial affairs.”
What happens to the trust after the grantor passes away?
“Upon the grantor’s death,” Steve explains, “the Revocable Living Trust becomes irrevocable. This means no further changes can be made. The successor trustee, named by the grantor, takes over management of the assets and distributes them according to the grantor’s wishes as outlined in the trust document.”
“It’s important to note that a Revocable Living Trust doesn’t eliminate estate taxes,” Steve clarifies. “However, it can be structured in a way that minimizes potential tax liabilities.”
Have you encountered any common issues or challenges when setting up these types of trusts?
Steve pauses thoughtfully. “Well, one situation I often see is families who haven’t discussed their estate plans openly. Sometimes, there are differing opinions about how assets should be divided. Having honest conversations with loved ones beforehand can prevent misunderstandings and potential conflicts down the road.”
