This may be due to cognitive decline, mental illness, developmental disability, or other impairments, and can leave the individual vulnerable to exploitation, fraud, or undue influence.

    Because guardianship can significantly restrict a person’s autonomy and decision-making rights, it is generally considered a measure of last resort. Courts typically require that less restrictive alternatives—such as powers of attorney, supported decision-making arrangements, or advance directives—be thoroughly explored and deemed ineffective or unavailable before appointing a guardian or conservator.
