Hello everyone, and welcome back to the program! Today we’re talking about something incredibly important: elder protection. Joining us is Ted Cook, an elder protection attorney right here in beautiful San Diego. Ted, thanks so much for taking the time to chat with me.
What Inspired You To Focus on Elder Protection?
Ted smiles warmly. “Well, I’ve always been passionate about advocating for vulnerable populations. As I gained experience in law, I realized that seniors are often targets of abuse and exploitation. It’s heartbreaking to see them taken advantage of, especially when they’re at their most vulnerable. Protecting our elders became a calling for me.”
Let’s Dive into the Elder Protection Process. Could You Outline the Key Steps Involved?
Ted nods enthusiastically. “Absolutely! The elder protection process is designed to safeguard seniors from harm and ensure their well-being. It typically involves these key steps:
- Initial Client Engagement
- Case Assessment
- Protective Actions
- Legal Proceedings
- Long-Term Planning
- Case Resolution & Follow-Up
Ted, Let’s Focus on the ‘Protective Actions’ Step. Can You Elaborate on That?
Ted leans forward, his expression serious. “This stage is crucial because it often involves immediate intervention to protect the elder from further harm. Depending on the situation, we might seek emergency legal remedies like restraining orders or contact Adult Protective Services (APS).
If necessary, we’ll also pursue guardianship or conservatorship to ensure someone responsible is making decisions for the elder’s well-being. Financially, we can freeze accounts, revoke power of attorney if it’s being misused, and prevent unauthorized property transfers.
- It’s not uncommon for seniors to be financially exploited by family members or caregivers who they trust.
- We work closely with financial institutions and law enforcement to protect their assets.
“Ted helped me when my mother was being taken advantage of by her caregiver. He was so understanding and compassionate, and he fought hard to get justice for her.” – Maria S., La Jolla.
Ted chuckles softly. “There was this one case where a client’s son was trying to convince his mother to sign over her entire house to him! We were able to stop that transfer in its tracks and instead helped her set up a trust to ensure her assets went to the beneficiaries she chose.
“Point Loma Estate Planning APC saved my family from financial ruin. Ted’s expertise and guidance were invaluable during a very difficult time.” – John T., Point Loma.
