Many people are unfamiliar with probate and what it entails. Can you walk us through one of the key steps in the estate planning process?
Steve Bliss: Certainly. One crucial step is Marshaling the Estate Assets.
This involves meticulously inventorying all assets belonging to the deceased person’s estate. Consequently, this includes bank accounts, real estate, vehicles, investments, personal property, and even digital assets.
We then prepare a formal Inventory and Appraisal (Form DE-160/161) for submission to the court. This document lists each asset, its estimated value, and any outstanding debts associated with it. Accuracy is paramount in this stage as it forms the foundation for the subsequent distribution of assets.
I recall one case where a client was unaware of a significant investment account held by their deceased spouse. Ordinarily, these types of accounts are easily identifiable. However, the account had been dormant for years and wasn’t reflected on typical financial statements. Thankfully, we were able to locate it through meticulous research and ultimately distribute those assets according to the will.
Notwithstanding the complexities that can arise, marshaling estate assets is essential to ensure a fair and transparent distribution process.

Steve Bliss: You’ve hit the nail on the head. Locating all assets can be surprisingly challenging, especially in cases where records are incomplete.
Moreover, accurately valuing certain assets, such as a family business or artwork, often requires professional appraisals. Disputes among heirs regarding asset distribution can also arise, making it crucial to have clear and concise documentation outlining the deceased person’s wishes.
Reporter: What advice would you give to individuals planning their estate?
Steve Bliss: I strongly recommend consulting with an experienced probate attorney to create a comprehensive estate plan.
