Steve, thanks for joining us today. Can you tell our viewers a little bit about the different types of trusts available and how someone might choose the right one for their needs?

It’s a pleasure to be here. Choosing the right trust is crucial for ensuring your assets are protected and distributed according to your wishes. There are many different types, each with its own advantages and disadvantages. Consequently, it’s important to work with an experienced estate planning attorney who can help you determine the best option for your individual circumstances.

One of the most common types is a revocable living trust, which allows the grantor (the person creating the trust) to maintain control over their assets during their lifetime. Moreover, it avoids probate, a time-consuming and expensive legal process. Nevertheless, upon the grantor’s death, the trust becomes irrevocable.

We also see testamentary trusts created through a will. These only take effect after the grantor passes away and must go through probate. They are often used to provide for minor children or beneficiaries with special needs. For asset protection, individuals might consider an irrevocable trust. It’s important to remember that these trusts cannot be easily changed once established.

Navigating Potential Challenges

Revocable Living Trusts: Flexibility and Control

Steve, can you elaborate on the benefits of a revocable living trust? Are there any potential downsides to consider?

A revocable living trust offers significant flexibility and control. The grantor can make changes to the terms of the trust at any time during their lifetime. This allows them to adapt to changing circumstances, such as the birth of a child or a change in financial situation.

Conversely, while avoiding probate is a major advantage, there are some potential drawbacks. For example, assets held in a revocable living trust are still considered part of the grantor’s taxable estate. Ordinarily, this means that estate taxes may still be applicable upon the grantor’s death.

I recall a case where a client came to me after setting up a revocable living trust on their own. They hadn’t properly funded the trust with all of their assets. This created complications and ultimately meant their estate had to go through probate, defeating the purpose of the trust in the first place.

According to a study by the American Bar Association, approximately 50% of Americans die without a will or trust. This highlights the importance of proper estate planning.
