Interview with Steve Bliss, Escondido Probate Attorney

Handling Debts and Taxes: A Critical Step in Probate

Steve, thank you for joining us today to shed some light on the probate process. Many people find it complex and overwhelming. Could you tell our viewers about one of the key steps involved?

Certainly. One crucial step is handling debts and taxes. Ordinarily, this stage follows the marshalling of estate assets, where we meticulously inventory all possessions.

Now, paying valid creditor claims is paramount. We must diligently review all claims against the estate, ensuring they are legitimate and properly documented. This involves scrutinizing invoices, contracts, and other supporting evidence. Conversely, if a claim appears questionable or inflated, we may contest it in court to protect the estate’s assets.

Moreover, filing and paying any taxes due is equally important. This includes federal estate tax, which applies only to estates exceeding a certain threshold—currently $12.92 million for individuals (2023). According to the IRS, approximately 0.1% of estates are subject to federal estate tax, highlighting its significance primarily for high-net-worth individuals.

There have been instances where heirs were unaware of substantial debts incurred by the deceased. Consequently, these debts threatened to deplete the estate’s assets, leaving little for distribution. I recall a case where an individual had accumulated significant credit card debt without informing their family. It was a difficult situation, requiring careful negotiation with creditors to minimize the impact on the beneficiaries.

Ensuring Smooth Distribution

Handling debts and taxes efficiently is essential for ensuring a smooth distribution of assets. What happens next in the probate process?

Once all debts are settled and taxes paid, we prepare a detailed accounting for the court’s approval. This document meticulously outlines all income and expenses related to the estate. After the court reviews and approves the accounting, we obtain a court order authorizing the distribution of remaining assets to the heirs or beneficiaries.
